Terms of Service

Please read these terms carefully before using StitchFast.

1. About These Terms

These terms of service ("Terms") govern your use of the StitchFast website, application, and embroidery digitizing service ("Service") operated by DadLink Technologies Limited, a company registered in England and Wales (company number 14396553) with its registered office at 7 Chelford Road, Handforth, SK9 3SQ ("we", "us", "our").

By creating an account or using the Service, you agree to be bound by these Terms. If you do not agree, you must not use the Service.

2. The Service

StitchFast is an AI-powered embroidery digitizing service. You upload images and the Service processes them into machine-readable embroidery stitch files (including DST, PES, JEF, EXP, VP3, HUS, and XXX formats). The Service includes AI design analysis, colour quantization, stitch generation, thread colour matching, and file export.

The Service is provided on an "as is" and "as available" basis. We do not guarantee that digitized files will produce perfect results on every embroidery machine, fabric type, or thread combination. Results may vary depending on machine calibration, fabric tension, thread quality, and stabiliser use. You are responsible for testing stitch files before production runs.

3. Accounts

To download embroidery files, you must create an account by providing your name, email address, contact number, and a password. You must provide accurate information and keep your login credentials secure. You are responsible for all activity under your account.

You must be at least 18 years old to create an account. We reserve the right to suspend or terminate accounts that violate these Terms, are used fraudulently, or remain inactive for more than 12 months.

Your account is personal to you and may not be shared with or transferred to another person or entity without our written consent.

4. Credits and Payments

The Service operates on a credit-based system. Each design download costs one credit. Credits can be purchased individually or in packs at the prices displayed on the accounts page. All prices are in pounds sterling (GBP) and inclusive of VAT where applicable.

Credits are non-transferable and are tied to your account. Purchased credits do not expire. One credit is deducted each time you successfully download a digitized embroidery file. Previewing and digitizing designs does not use a credit — only downloading the final file does.

If a download fails due to a technical error on our side, the credit will be automatically refunded to your account.

All payments are processed securely by Stripe. We do not store your card details. By making a purchase, you also agree to Stripe's terms of service.

5. Subscriptions

We offer an unlimited subscription plan at £29.99 per month, which provides unlimited design downloads for the duration of the subscription. The subscription renews automatically each month unless cancelled.

You may cancel your subscription at any time from your account page or via the Stripe customer portal. Cancellation takes effect at the end of the current billing period — you will retain access until then. No partial refunds are given for unused portions of a billing period.

If a subscription payment fails, you will be given a 24-hour grace period to update your payment method. After 24 hours, download access will be suspended until payment is resolved. If payment is not resolved within 14 days, the subscription will be cancelled automatically.

6. Refund Policy

Due to the digital nature of the Service, we generally do not offer refunds on purchased credits or subscription payments once the service has been used. However, we will consider refund requests on a case-by-case basis in the following circumstances:

To request a refund, contact us at support@stitchfast.co.uk with your account email and a description of the issue. We aim to respond within 48 hours.

This policy does not affect your statutory rights under the Consumer Rights Act 2015.

7. Intellectual Property

Your designs: You retain full ownership of any images you upload and any embroidery files generated from them. We do not claim any intellectual property rights over your designs. We do not use your uploaded images for training, marketing, or any purpose other than processing your immediate digitizing request.

Our service: The StitchFast name, logo, website, software, algorithms, and all associated intellectual property are owned by DadLink Technologies Limited. You may not copy, modify, distribute, or reverse-engineer any part of the Service.

Your responsibility: You are solely responsible for ensuring that you have the right to digitize and reproduce any image you upload. You must not upload images that infringe the copyright, trademark, or other intellectual property rights of any third party. We are not liable for any intellectual property disputes arising from designs you upload.

9. Limitation of Liability

To the fullest extent permitted by law, DadLink Technologies Limited shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the Service, including but not limited to loss of profits, data, business opportunity, or goodwill.

Our total liability to you for any claim arising from these Terms or your use of the Service shall not exceed the total amount you have paid to us in the 12 months preceding the claim.

Nothing in these Terms excludes or limits our liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be excluded or limited under English law.

10. Data Protection and Privacy

We process your personal data in accordance with our Privacy Policy and the UK General Data Protection Regulation (UK GDPR). By using the Service, you consent to the processing of your data as described in our Privacy Policy.

In summary, we collect your name, email address, contact number, and payment information for the purpose of providing the Service. We do not sell your personal data to third parties. Uploaded images are processed for digitizing purposes only and are not retained after processing is complete.

11. Service Availability

We aim to keep the Service available at all times but do not guarantee uninterrupted access. The Service may be temporarily unavailable due to maintenance, updates, server failures, or circumstances beyond our control. We will endeavour to give reasonable notice of planned maintenance where possible.

We reserve the right to modify, suspend, or discontinue any aspect of the Service at any time. If we discontinue the Service entirely, we will honour any unused purchased credits by offering refunds or reasonable alternative arrangements.

12. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will notify you by email or by posting a notice on the website. Your continued use of the Service after changes are posted constitutes your acceptance of the revised Terms.

The date at the top of this page indicates when these Terms were last updated.

13. Governing Law and Disputes

These Terms are governed by and construed in accordance with the laws of England and Wales. Any disputes arising from these Terms or your use of the Service shall be subject to the exclusive jurisdiction of the courts of England and Wales.

If you are a consumer, you may also have the right to bring proceedings in your local courts if you reside in another part of the United Kingdom.
